The term "Product" refers to products and software manufactured by Flying Neurons including SuperNeurone, SuperNeuroFly and any software and accessory manufactured by Flying Neurons.
By proceeding to install, run and/or use the Product, you confirm that you accept and agree to be bound by the terms of this document. If you do not agree with these terms, do not purchase or use this product.
It is the responsibility of those installing and using this article to determine that the installation and working conditions are within required standards.
It is the pilot’s responsibility to decide to use our product.
Flying Neurons warrants the Product to be free from defects in materials and manufacturing under normal use for a period of 2 years from the date of purchase. The original purchase invoice or receipt, indicating the date of purchase of the Product, constitutes proof of the date of purchase. All software provided with the Product, including firmware, is provided "as is". Flying Neurons does not warrant that the operation of such software will be uninterrupted or error-free, or that such software will meet your requirements. If you make a claim under this Warranty, Flying Neurons may, at its option, repair or replace all or part of the defective Product covered by the Warranty with new or refurbished products or parts. In the event that Flying Neurons chooses to use refurbished parts or products, they will have characteristics or performance equivalent to new products.
IN NO EVENT SHALL FLYING NEURONS BE LIABLE FOR ANY INCIDENTAL, SPECIAL OR CONSEQUENTIAL DAMAGES, INCLUDING, BUT NOT LIMITED TO, LOST PROFITS, LOST DATA OR DOWNTIME, WHETHER THE CLAIM IS BASED IN CONTRACT, TORT OR WARRANTY, WHETHER RESULTING FROM THE USE, MISUSE OR INABILITY TO USE THE PRODUCT OR FROM DEFECTS IN THE PRODUCT, EVEN IF FLYING NEURONS HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.
Our product informs you of the presence of some aircrafts around you. It is not capable of detecting the entire air traffic and cannot warn in all situations. In particular warnings may be incorrect, late, missing, not being issued at all, show other threats than the most dangerous or distract the pilot's attention.
Our product does not work all the time. Certain requirements need to be met for our product to work properly. Examples are up-to-date software or the correct installation of the product, its antennas, and connected systems, GSM or Wi-Fi connection for getting information from internet or passing data to you connected apps.
Errors and failures in the product may occur. It is possible that the product fails during operation. It is possible that the product shows misleading and/or wrong information to connected cockpit systems and/or to other aircraft. Never absolutely rely on data given by the product.
Our product does not issue resolution advisories.
The use of the Product must not modify the behaviour of the pilot concerning his piloting and in particular collision risk management. It is the pilot’s responsibility to decide to use our product.
The Product will receive and transmit data regarding the identity and position of your own and other aircraft. You are granted the right to use this data for the purposes of secondary positional awareness and you grant Flying Neurons the right to use and transmit your aircraft identity and positional data.
